My friend has marijuana plants in her house, can i get arrested if cops come and im there visiting her?

i didnt even know what they were until she told me. can cops come anytime in her apt and arrest her and or me?

Any person in the house of your friend will be arrested in case of a raid but you can cite the defense that you are just visiting.
Reply:Same as being in a car with someone who has marijuana in the car, you are suspect and they have reason to arrest.
Reply:It is possible that you could be charged with cultivation of marijuana. The police would need an search warrant and if you happened to be there it is more than likely they would question you and let you go home UNLESS they had reason to believe you had an active part in the cultivation.



I don't know the drug laws in NYC, in California it would be a misdemeanor to grow pot for personal use, intent to distribute pot would carry a stiffer sentence of upto 5 years (I think)



Best to stay away as much as possible because now that you know it is there you are aiding and abbeting.
Reply:You can't be convicted of anything because the plants were never in your possession. There seem to be some people around here who are of the opinion that merely being near anybody who has anything to do with drugs is illegal, but the fact is you would have to be helping her handle the stuff or be using/distributing it in some way in order to be committing any crime. But you can expect to be arrested and interrogated if the cops show up while you're there. It's your friend's house, so the plants will be assumed to be in her possession, so absent any evidence that you have anything to do with those plants, the prosecutor really has nothing to charge you with.

Reply:My ex actually brought in a marijuana plant into our house and proceeded to tell me that he would take care of it, I didn't need to worry about it and that he and his 'buddy' were going into business to deal nickel bags!



I picked it up, threw it in the trash, left his sorry @ss and wrote to his father and told him what his ex VietNam Vet son was doing, who he was doing it with and their intent to deal and the fact that I, his wife, was sure as he-- NOT going to jail as an accomplice in this matter.



To answer your question, YES, if you are not reporting it, (snitching) then you are a party to the crime with intent to distribute. Get away from these people as fast as you can! Bad news.



It's no different than a wife who actually has no knowledge of her husband's embezzling activity or any other illegal activity he may be doing and the cops put a wire-tap on their phone and the husband calls the wife and says something like: "just take my briefcase over to Tom's house and don't ask any questions OK!? Just do it." That husband just made his wife a party to a crime. No matter if she knew it or says she didn't. She'll need a good lawyer.

Why? Because once she puts her fingerprints on that briefcase, she'll play he-- trying to prove her innocence. Whether she was aware of her husband's activities or not. Period!



I say again, get away from these people NOW!
Reply:Yes and the time will be determined by the quantity and quality of the plants and would be up to a judge or jury.All they need to come into the apartment is probable cause.They would need a search warrant for the plants if they aren't in plain sight.Her light bill or an odor would give them probable cause, allowing them to get a warrant.
Reply:My cousin lived next door to me for 2 or 3 years and I seldom went to his house because he and his wife smoked marijuana / angel dust off and on while they lived there (and after they moved away).



I worked at a large PD in OH and knew all too well that if the police went in and raided the place and I was there, I was going to jail, too, because too many claim innocence when they aren't so who are the police supposed to believe at a time like that? No one.



Be thankful she told you what it was so when she wants you to come over, you can tell her no and then tell her why.



Personally, I like to close and open my own doors without help from any guards.

No they can not come into her apartment at anytime unless they have a warrant.
Reply:They can arrest you, certainly. Then you call your lawyer, and within 72 hours, you're out... unless a prosecutor decides to charge you, in which case you stay in jail until your bail hearing. Totally NOT fun.



Do you want to spend up to 72 hours in jail, and have to call your lawyer, who will charge you $$$? Do you want to potentially have to come up with bail money?



Meet your friend in a public park. If your friend is carrying marijuana on her at the park, well, that's one friend you don't need.

Reply:Yes,you and they would charge you with Loitering in a drug house and that's a misdemeanor no prison time and most likely no jail time just probation.Even though you though i told you the facts that don't mean go over there due to lesser punishment!
Reply:Don't worry about the cops. They will merely take the evidence and bake them into brownies. They will then OD of weed and get a massive panic attack and call 911 thinking that they are dying. They will see penguins and mythological beasts and say that time is going by really,really,really,really, slow.
